New Jersey No Fault Lawyers
Once someone realizes that they were injured in a car accident, they are bound to wonder who is going to pay for the medical treatment. The basic answer that your own insurance carier will pay the doctors to treat your injuries (or the insurance company that insures the vehicle, if you don’t personally have any auto insurance). This is what is covered under the No Fault or PIP portion of the insurance policy. It is called “No Fault” because the law says that the insurance company must quickly pay for the medical bills, regardless of who is at fault for the car accident. But unfortunately people may be faced with insurance carriers who do not want to pay for treatment, and you will then have to proceed forward with enforcing your No Fault Insurance claim.
A very important thing to remember is that there are many laws and rules involved in No Fault claims. The most basic rule is that you absolutely MUST notify the insurance company right away that you were hurt in an auto collision. This is NOT the time to worry about whether your insurance rates will increase (as an aside, your insurance rates generally will only increase if you are at fault for a car accident). The State of New Jersey Department of Banking and Insurance has a handy list of the phone numbers for all of the insurance companies licensed to do business in New Jersey – you should call the insurance company at that number to report you PIP claim, and make sure to write down the PIP claim number and the name of the adjuster assigned to the file.
Even when claims are properly reported and the doctors follow all of the rules involved, PIP carriers may decline coverage. For example, they may send you for an “independent” medical examination , and the doctor hired by the insurance company may report that a surgery or procedure, which YOUR DOCTOR prescribed, is not necessary, or designed to treat some condition that is not related to the car accident. A situation like this could create a huge problem for someone seriously injured in an automobile accident – especially if there is no other way that the medical treatment could be paid for.
